Terms of Service

1. Acceptance of Terms

These Terms of Service (the “Terms”) are entered into between you and Gorka Systems LLC, a Wyoming limited liability company doing business as “Gorka Systems” (“Gorka Systems,” “we,” “us,” or “our”). By accessing or using this website (the “Site”), you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Site.

2. About the Site

This Site is an informational marketing website operated by Gorka Systems that describes the services we offer. Nothing on the Site creates a client relationship, a contract for services, or any obligation on our part to provide services to you. Services described on the Site are provided only under a separate written agreement between Gorka Systems and each client.

Third-party platforms. We use third-party customer relationship management (CRM) and communications platforms to operate this Site, manage inquiries, and (with your consent) deliver email, phone, voicemail, and SMS communications. By submitting a form on this Site, you understand that your information will be processed by these third-party platforms in addition to being received by us. See our Privacy Policy for details.

3. Payments & Billing

The Site does not process payments. No purchase, subscription, or payment transaction is completed through this Site itself. Submitting a form or otherwise interacting with the Site does not create a payment obligation.

Any pricing, packages, or service tiers referenced on the Site are illustrative and subject to change. If you choose to engage Gorka Systems for services, all fees, billing terms, recurring charges, refund eligibility, taxes, and payment methods will be set out in a separate written services agreement (and, where applicable, a separate subscription or order form) entered into between you and Gorka Systems. That agreement, not this Site, governs payments.

Any third-party payment processor used in connection with that separate agreement (for example, a credit card processor or invoicing platform) operates under its own terms and privacy policy.

4. Eligibility

You must be at least 18 years old and have the legal authority to agree to these Terms, on your own behalf or on behalf of any business you represent, to use the Site.

5. Intellectual Property

All content on the Site — including text, graphics, logos, icons, images, audio, video, animations, source code, compiled code, layout, design, and the Gorka Systems name, logo, and other marks — is owned by Gorka Systems or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to view and interact with the Site for your personal, non-commercial evaluation of our services. All other uses are prohibited. Without our prior written permission, you may not:

  • Copy, reproduce, republish, or redistribute any part of the Site.
  • Scrape, crawl, harvest, or extract content from the Site using any automated tool or method.
  • Use the Site, or any content on it, to train, fine-tune, or evaluate any machine-learning model, large language model, or other artificial intelligence system.
  • Reverse engineer, decompile, or attempt to extract the source code of any software made available through the Site.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notice.

6. Contact Form Submissions

When you submit the contact form, you represent that the information you provide is accurate, that it belongs to you or that you have permission to share it, and that submitting it does not violate any law or the rights of any third party. Please do not send us confidential or sensitive information (including health, financial, or legal matters) through the form. All submissions are handled as described in our Privacy Policy.

7. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Interfere with, disrupt, or place an unreasonable load on the Site or any server or network connected to it.
  • Attempt to gain unauthorized access to any part of the Site or its underlying infrastructure.
  • Upload or transmit any virus, worm, malware, or other malicious code.
  • Impersonate any person or misrepresent your affiliation with any person or entity.
  • Harvest email addresses, phone numbers, or other personal information from the Site.

8. SMS Messaging Terms

Program description. Our contact form presents two distinct SMS consent checkboxes, both unchecked by default and independent of each other. By ticking the transactionalcheckbox you opt in to receive transactional text messages relating to your inquiry — appointment confirmations, reminders, reschedule notices, and direct one-to-one replies about your discovery call. By ticking the marketing checkbox you opt in to receive promotional text messages about special offers, discounts, and new software features. You may opt into one, both, or neither. Each opt-in is collected on its own unchecked checkbox and is never bundled with acceptance of these Terms or our Privacy Policy.

Cancellation (STOP).You can cancel the SMS service at any time. Just text “STOP” in reply to any message we send you. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Help (HELP). If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at adam@gorkasystems.com or by phone at (855) 629-5452.

Carrier liability. Carriers are not liable for delayed or undelivered messages.

Message and data rates. As always, message and data rates may apply for any messages sent to you from us and to us from you.

Message frequency. You will receive messages at a frequency that varies based on your inquiry activity (typically fewer than five messages per inquiry). If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

No third-party sharing. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Third-Party Links and Services

The Site may contain links to third-party websites or tools (for example, embedded video or social media). We do not control and are not responsible for the content, privacy practices, or availability of those third-party services. Your use of any third-party service is governed by that service's own terms and privacy policy.

10. No Professional Advice

Content on the Site — including any blog posts, case studies, performance claims, marketing strategy discussions, or AI-generated content — is provided for general informational purposes only. It is not legal, financial, tax, accounting, or professional business advice, and it should not be relied on as a substitute for advice from a qualified professional who knows your specific situation. Any results or outcomes described are illustrative and are not a guarantee of the results you will achieve.

11. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FUNCTIONALITY, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GORKA SYSTEMS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, UNINTERRUPTED OPERATION, AND FREEDOM FROM ERRORS OR VIRUSES. WE DO NOT WARRANT THAT THE SITE WILL MEET YOUR REQUIREMENTS OR THAT ANY INFORMATION ON IT IS CURRENT, COMPLETE, OR ACCURATE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GORKA SYSTEMS, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

13. Indemnification

You agree to indemnify, defend, and hold harmless Gorka Systems and its officers, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

14. Termination

We reserve the right to suspend or terminate your access to the Site at any time, with or without notice, for any conduct that we believe (in our sole judgment) violates these Terms, applicable law, or the rights of any other person, or that we believe is harmful to other users, to us, or to third parties.

You may stop using the Site at any time. If you have engaged Gorka Systems for services under a separate written agreement, the termination of those services is governed by that agreement, not by these Terms. You can request that we delete information you have submitted through the Site at any time by contacting us at adam@gorkasystems.com.

Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and this section — will survive any termination of your access to the Site.

15. Governing Law and Venue

These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. You and Gorka Systems agree that any action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and both parties consent to the personal jurisdiction of those courts.

16. Informal Dispute Resolution

Before filing any claim or lawsuit, you agree to first send a written description of the dispute to adam@gorkasystems.com and to give us at least 30 days to resolve the issue informally. Most disputes can be resolved this way without the time and expense of litigation.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If we make material changes, we will provide more prominent notice. Your continued use of the Site after changes take effect means you accept the updated Terms.

18. General

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Gorka Systems regarding the Site and supersede any prior understandings.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
