This Privacy Policy explains how Gorka Systems LLC, a Wyoming limited liability company doing business as “Gorka Systems” (“Gorka Systems,” “we,” “us,” or “our”) collects, uses, and protects information when you visit this website or contact us through our contact form. 2. Scope of This Policy

This policy covers only this website and the information you submit to us directly. It does not cover the marketing systems we build and operate for our clients — those are governed by separate agreements between Gorka Systems and each client, and between each client and their own end customers.

3. Information We Collect

Information you give us directly.The contact form on this website collects your name, phone number, and the content of your message. Submitting the form is always optional. The form also presents two separate, unchecked SMS consent checkboxes — one for transactional SMS, one for marketing SMS. If you tick either or both, we also use your phone number to send you the SMS type(s) you opted into (see Section 6).

Information collected automatically. Our hosting provider records standard server log data when your browser requests a page from us, including your IP address, browser type, operating system, the page you requested, and the time of the request. This data is used to operate and secure the site.

Cookies. This site does not use analytics, advertising, or tracking cookies. Our hosting provider may set a small number of strictly necessary cookies required for the site to function (for example, to route requests correctly). We do not use cookies to build profiles or track you across other websites.

4. How We Use Your Information

We use the information we collect to:

  • Respond to your inquiry and schedule a discovery call.
  • Follow up with you directly about your inquiry.
  • Send you transactional SMS about your discovery call — appointment confirmations, reminders, reschedule notices, and direct replies — if you opted in by ticking the transactional SMS checkbox on the form.
  • Send you marketing SMS about special offers, discounts, and new software features — if you opted in by ticking the marketing SMS checkbox on the form (collected separately from transactional consent).
  • Operate, maintain, and secure this website.
  • Comply with legal obligations.

We do not use your information for automated decision-making, profiling, or any purpose you would not reasonably expect from the context in which you provided it.

5. How We Share Your Information

We share information only with service providers who help us operate this site and respond to you. Each provider is bound by its own privacy terms:

We do not sell or share your personal information as those terms are defined under the California Consumer Privacy Act (CCPA) or any other US state privacy law. We will disclose information only if required by law, valid legal process, or to protect our rights, property, or safety, or the rights, property, or safety of others.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

6. SMS / Mobile Messaging

Program description. Our contact form presents two distinct SMS consent checkboxes, both unchecked by default and independent of each other:

  • Transactional SMS.If you tick this box, Gorka Systems LLC may send you transactional text messages relating to your inquiry — appointment confirmations, reminders, reschedule notices, and direct one-to-one replies about your discovery call.
  • Marketing SMS. If you tick this box, Gorka Systems LLC may send you promotional text messages about special offers, discounts, and new software features.

You may opt into one, both, or neither. Consent to receive SMS of either type is nota condition of any purchase or of contacting us, and each opt-in is collected on its own unchecked checkbox — never bundled with acceptance of these terms or our Privacy Policy.

Consent. By submitting your phone number on our contact form and checking one or both SMS consent boxes, you opt in to receive the corresponding SMS type(s) from Gorka Systems LLC at the number provided, including messages sent using automated technology.

Message frequency. Message frequency varies based on your inquiry activity and, if you opted into marketing SMS, occasional promotional sends. Most transactional senders receive fewer than five (5) messages per inquiry.

Message and data rates. Message and data rates may apply for any messages sent to you from us and to us from you. Contact your wireless provider for details about your text or data plan.

Opt-out (STOP). You can cancel the SMS service at any time. Just text STOP in reply to any message we send you. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Help (HELP). If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at adam@gorkasystems.com or by phone at (855) 629-5452.

Carrier liability. Carriers are not liable for delayed or undelivered messages.

Sharing of mobile information. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Terms of service. Your use of our SMS messaging program is also governed by the SMS Messaging Terms section of our Terms of Service.

7. Data Retention

We keep contact form submissions in our CRM for as long as needed to respond to your inquiry and for a reasonable follow-up period, not to exceed 24 months from the date of submission unless you ask us to keep them longer. Server log data is retained by our hosting provider in accordance with its standard retention schedule (typically 30 days).

You can ask us to delete your information earlier at any time by emailing adam@gorkasystems.com.

8. Your Rights

US state privacy rights. Depending on where you live, you may have the right to:

  • Know what personal information we have collected about you and how we use it.
  • Request a copy of the personal information we hold about you.
  • Correct inaccurate personal information.
  • Delete your personal information.
  • Opt out of the sale or sharing of personal information. We do not sell or share personal information, so this right is automatically honored.
  • Not be discriminated against for exercising any of these rights.

These rights are available to residents of states that have enacted comprehensive privacy laws, including California (CCPA/CPRA), Colorado, Connecticut, Texas, Virginia, and others. To exercise any of these rights, email adam@gorkasystems.com. We will verify your identity before acting on the request and will respond within 45 days as required by the CCPA.

Visitors from outside the United States. If you are located in the European Economic Area, the United Kingdom, or another region with comparable privacy laws, you may have similar rights under local law. You can exercise them by emailing us at the same address.

9. Security

We use industry-standard administrative and technical safeguards to protect the information we collect, including TLS encryption in transit and reliance on vendors who provide encryption at rest. No system is perfectly secure, and we cannot guarantee the absolute security of any information you transmit to us.

10. Children's Privacy

This website is intended for business owners and is not directed to children under 13. We do not knowingly collect personal information from children. If you believe we have collected information from a child, please contact us and we will delete it.

11. International Users

Our business and service providers are located in the United States. If you access this website or contact us from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States, and you consent to that transfer.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last updated” date at the top of this page. If we make material changes, we will provide more prominent notice, such as a banner on the site.
